These Terms of Service (“Terms”) are an agreement between you and Laff Studios LLC, a Wyoming limited liability company (“FashAI,” “we,” “us,” or “our”). They govern your use of the FashAI app on iOS and Android and the fashai.app website (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country, to use FashAI. If you use the Service for an organization, you confirm that you are authorized to accept these Terms on its behalf.

Your account

You are responsible for the activity on your account and for keeping your login credentials safe. Tell us promptly if you suspect someone else is using your account. We may suspend or close accounts that break these Terms.

License to use FashAI

We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own styling purposes, subject to these Terms.

Subscriptions and billing

FashAI offers optional paid subscriptions that unlock premium features.
Purchases are handled by the Apple App Store or Google Play through our payments partner, RevenueCat. Payment is charged to your store account when you confirm.
Subscriptions renew automatically unless you cancel at least 24 hours before the current period ends. You can manage or cancel a subscription anytime in your Apple ID or Google Play settings.
Refunds are handled by Apple or Google under their policies, except where the law requires otherwise.

Your content

You keep ownership of the photos, posts, and other content you upload (“User Content”). You give FashAI a limited license to host, process, and display your User Content so we can run the features you use, such as Virtual Try-On, Digital Twin, and the community feed. You are responsible for having the rights to whatever you upload, and you must not upload content that is unlawful, infringing, or that shows another person without their consent.

Community rules

FashAI includes social features where you can post looks, comment, message, and follow other members. There is zero tolerance for objectionable content or abusive users. You agree not to post content that is sexually explicit, hateful, harassing, violent, or otherwise illegal, and not to harass, threaten, or impersonate anyone. Posting, commenting, or messaging on FashAI means you accept these Terms.

Shared images are screened for nudity before they go live, and content that fails is not published. You can report any post, comment, message, or member from the menu on it, and you can block anyone so their content is hidden from you both ways. We review every report and, where the content or the behaviour breaks these rules, we remove the content and eject the member responsible within 24 hours. Serious or repeated violations end the account permanently.

Acceptable use

You agree not to:

Reverse engineer, scrape, or misuse the Service or its AI output.
Upload harmful, illegal, or infringing content, or impersonate anyone.
Interfere with the security of the Service or disrupt how it runs.
Use the Service to build a competing product or to break any law.

AI-generated results

Try-on images and styling suggestions are generated by AI and are meant as illustrations. They may not match real fit, color, size, or availability. Confirm the details with the retailer before you buy.

Shopping and third-party retailers

The Service links to third-party retailers, and some of these links are affiliate links that may earn us a commission when you buy. Your purchase is a transaction between you and the retailer. We are not responsible for their products, prices, content, or practices.

Advertising

Free accounts may see ads within the app. A FashAI subscription removes them. We are not responsible for the products or claims in third-party ads.

Apple App Store

These Terms are between you and FashAI only, not Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for FashAI. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund what you paid for it; to the maximum extent the law allows, Apple has no other warranty obligation. Apple is not responsible for handling any claim you or anyone else makes about the app, including product liability, any failure to meet a legal or regulatory requirement, consumer protection claims, and claims that the app infringes someone else’s intellectual property. You confirm that you are not in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Intellectual property

The Service, including its software, design, and branding, belongs to FashAI and is protected by intellectual property laws. These Terms do not give you any rights to our trademarks or content beyond what is stated here.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent the law allows. We do not promise that the Service will be uninterrupted or error-free, or that results will meet your expectations.

Limitation of liability

To the maximum extent the law allows, FashAI is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising from your use of the Service.

Termination

You can stop using the Service at any time and delete your account from the app settings. We may suspend or end your access if you break these Terms or if we discontinue the Service.

Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Before filing anything, email us at support@fashai.app and give us 30 days to sort it out; most problems end there. Otherwise the courts of Sheridan County, Wyoming have jurisdiction.

If you are a consumer in the EEA or the UK, none of this deprives you of the protection of the mandatory law of your country of residence, and you may bring proceedings in your local courts.

Changes to these Terms

We may update these Terms as the Service changes. We will update the “Last updated” date above and, where appropriate, give notice in the app. If you keep using the Service after changes take effect, you accept the updated Terms.
